Eligibility: The United Packages 2024 Cancun Sweepstakes (“Sweepstakes”) is only open to permanent legal residents of the fifty (50) states of the United States (“U.S.”) and the District of Columbia (“D.C.”) (excluding Guam, Puerto Rico, and all other U.S. territories and possessions) who are currently physically located and residing therein. Entrants must be eighteen (18) years of age or the age of majority in their state of residence as of the date of entry into the Sweepstakes. Entrants must also have either a valid Social Security number and/or a valid U.S. Individual Taxpayer Identification Number. Employees of priceline.com LLC (“Sponsor”), Enteractive Solutions Group, Inc. (“Sweepstakes Administrator”), Grupo Inmobiliario MOSA DBA Kempinski Hotel Cancun (“Kempinski Cancun”), United Airlines, Inc. (United Airlines), (each a “Prize Provider”), the advertising or promotion agencies of these companies/entities, those involved in the production, development, implementation, or handling of the Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, owners, principals, subsidiaries, franchisees, affiliates, licensees, service providers, retailers, distributors, employees, contractors, governors, related entities, partners, partnerships, agents, attorneys, insurers, representatives, shareholders, successors and assigns, or any other person or entity associated with the Sweepstakes (collectively “Sweepstakes Entities”) are not eligible to enter the Sweepstakes. Immediate family members (i.e., a spouse, domestic partner, child, sibling, parent, or any of their respective spouses, regardless of where they reside) and/or any person, whether related or not, living in the same household of an individual affiliated with a Sweepstakes Entity, are also ineligible to enter the Sweepstakes.

Sweepstakes Period: For all purposes of this Sweepstakes, the Sponsor’s computer is the official clock, and all times refer to Eastern Time (“ET”). The Sweepstakes period begins at 9:00:00 a.m. ET on May 1, 2024 and ends at 11:59:59 p.m. ET on June 14, 2024 (“Sweepstakes Period”).

How to Enter: To enter, prospective entrants must access the Sweepstakes website located at https://packages.united.com/wl/email/signup/sweepstakes/2024-cancun-sweepstakes/ (“Website”) and click on the Sweepstakes link or banner ad during the Sweepstakes Period. Then, entrants must submit the entry form by providing their email address and confirming they are eighteen (18) years of age or the age of majority in their state of residence and their compliance with these official rules by checking the appropriate box (“Entry Information”). After completing and successfully submitting the Entry Information, said entrant will then receive one (1) entry into the Sweepstakes (“Entry”). Entries must be received by 11:59:59 p.m. ET on June 14, 2024. Limit one (1) Entry per person/per email address during the Sweepstakes Period. All required Entry Information must be completed in full, be accurate, and be valid. The Entry Information must match the information of the entrant that completed the act of physically entering the Sweepstakes. Entrants who submit multiple Entries in excess of the limits stated herein will be disqualified. If entrants use a web-enabled mobile device to obtain an Entry, data rates may apply (entrants should contact their service provider for data rates/plans). Entrants should use care and not drive or operate machinery while entering the Sweepstakes. Any attempted form of entry other than as described herein is void. Proof of submitting an Entry will not be deemed by the Sponsor as proof of receipt or entry into the Sweepstakes. Any attempt by an entrant to obtain more than one (1) Entry by using multiple/different email addresses, identities, registrations, logins, or any other methods other than as described herein, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void that entrant’s Entry and that entrant may be disqualified. The Website may not be accessible from all mobile phones, handheld devices, and/or tablets. If an entrant experiences any issues entering, he/she should access the Website from a desktop or laptop computer.

Prize/Odds of Winning: One (1) prize will be available to be awarded in this Sweepstakes. The prize winner (“Winner”) will receive a five (5) day, four (4) night trip for Winner and Guest (“Guest(s)”) to Kempinski Hotel Cancun, Mexico (“Trip”). Trip will include: Stay for two people in a Deluxe Seaside room and breakfast for two people during the stay (Resort fee and Sanitation fee are not included). Trip also includes roundtrip United Airlines economy airfare for the Winner and Guest, in Booking Class H or lower, to Cancun, MX from the 48 contiguous United States or D.C. (excluding Alaska and Hawaii) collectively (“Prize”)). The Approximate Retail Value (“ARV”) of the Prize is $4,160.00

The Trip must be completed by June 30, 2025 or the Prize will be forfeited. Travel dates and arrangements are subject to air travel, holiday, blackout dates (28JUN24-08JUL24, 21JUL24-04AUG24, 21NOV24-02DEC24, 20DEC24-06JAN25, 29JAN25-01FEB25, 14FEB25-18FEB25, 21FEB25-24FEB25,11APR25-27APR25, 23-27MAY25, 30MAY25-02JUN25, 27JUN25-07JUL25), and other Prize and travel restrictions. Travel dates are subject to Kempinski Hotel Cancun, United Airlines, and Sponsor approval. Reservations are subject to availability. Flights must be booked at least twenty-one (21) days prior to the intended departure date. The hotel must be booked at least sixty (60) days prior to the intended departure date. If the Winner elects to partake in any or all portions of his/her Prize with no Guests, the Prize will be awarded to Winner and remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. If the Winner is between the ages of eighteen (18) and twenty-one (21), he/she must be accompanied by an adult of at least twenty-one (21) years of age in order to check into the hotel. Unless child or ward of Winner or one of the allotted Guests, each Guest must be eighteen (18) years of age or older as of the date of departure and must travel on the same itinerary and at the same time as the Winner. The Fair Market Value (“FMV”) of the Prize may vary depending upon the points of departure, ground transportation, and/or airline fare fluctuations; any difference between stated FMV and final FMV of Prize will not be awarded to the Winner. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, unspecified ground transportation, phone calls, baggage, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of Winner. Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, inspection charges, baggage fees, and security charges. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted.

Odds of winning the Prize depend on the total number of eligible Entries received during the Sweepstakes Period. Park tickets and airline tickets are non-transferable. Airline change fees may apply. Airfare may be booked only in the H booking class or a lower booking class. Tickets may be subject to availability, which is defined as an operational constraint, such as lack of meals or class of service requested is not available. There is a possibility that a seat will not be available for the Winner and Guest(s)’ intended flight(s). If this occurs, the Winner and Guest(s) will not be able to board the flight(s) and will not be entitled to any compensation. The Winner should check with United Airlines to confirm any additional black-out dates or flight restrictions. Airline reservations and ticketing arrangements must be made directly by the Sweepstakes Administrator upon receipt of Kempinski Hotel Cancun, United Airlines, and Sponsor approval. Once travel has commenced, reissues or extensions of airline travel are not allowed unless required and requested by United Airlines. Sweepstakes Entities are not responsible for any missed connections, delays of any kind, or any expenses incurred as a result of the use of the Prize. Flight schedules are subject to change without notice. Vouchers, coupons, gift cards, codes, and/or travel certificates if applicable, cannot be exchanged/redeemed for cash or combined with any other offer and are subject to the stated terms and conditions, which include expiration dates. Once Kempinski Hotel Cancun, United Airlines, and Sponsor's approval is secured, no change, extension, or substitution of the Trip dates is permitted, except by the Sponsor and/or the Prize Providers in their sole discretion. Once the details of the Trip have been confirmed by Sweepstakes Administrator, any cancellation or change fees or restructuring of the details are the sole responsibility of the Winner. If the Winner chooses to take more Guests than allotted in the Prize description, the Sponsor and/or Prize Providers are not responsible for arranging or booking such additional travel arrangements (i.e., flight reservations, hotel accommodations, park admission tickets). Winner or his/her Guest(s) must have/present at least one (1) major credit card in good standing to check-in to the hotel. If the Winner elects to travel without the allotted number of Guests or not to accept a Prize component, no additional or alternative compensation will be awarded. The Sponsor and/or Prize Providers reserve the right to award the Prize “as is” and to structure the travel route in their sole discretion. All expenses associated with the receipt or use of the Prize not specifically mentioned as being included (e.g., any requested upgrades/options/customs fees) are excluded and is the sole responsibility of the Winner. The Winner is solely responsible for all other incidentals/expenses associated with the receipt or use of the Prize that are not specifically mentioned as being included as part of the Prize, including but not limited to, taxes, additional air transfers, travel to/from an airport, government fees, ground transportation, meals, tips, gratuities, hotel incidentals, excursions, tours, laundry service, local, international and long distance telephone calls or other communications, mobile phone roaming fees, internet or wireless services, souvenirs, travel documents, service charges, travel insurance premiums, travel insurance, baggage fees, upgrades/options, and any other personal expenses.

Winner and Guest are solely responsible for providing all necessary identification and travel documents (e.g., passport, visas, medically advisable immunizations, proof of required vaccinations via a vaccine card, vaccine passport, health certificate, etc.). Passports must be valid for six (6) months after the return date of Trip. Failure to provide such documents may result in trip cancellation upon airport check-in. Winner and Guest(s) traveling are advised to familiarize themselves with and comply with the CDC travel guidelines located at https://wwwnc.cdc.gov/travel. Furthermore, all travelers understand that any trip may present an inherent risk of exposure to current and emerging infectious disease(s) including but not limited to COVID-19 and its variants, and the Sponsor cannot guarantee exposure during the trip will not happen. In order to comply with the REAL ID Act (https://www.dhs.gov/real-id), adult travelers carrying driver’s licenses from a select number of U.S. states may be required to present a valid U.S. passport to travel on a domestic commercial flight in addition to international travel. Failure to provide such documents may result in flight cancellation upon airport check-in. International travel carrying risk of disease or medically advisable immunizations. TRAVEL TO CERTAIN DESTINATIONS CARRIES AN INHERENT RISK OF DISEASE, INCLUDING BY WAY OF EXAMPLE ONLY, DENGUE, INFLUENZA, ZIKA, AND COVID-19 AND ITS VARIANTS. YOU ARE THEREFORE CAUTIONED TO CONSULT WITH A PHYSICIAN OR HEALTH CARE PROVIDER BEFORE TRAVELING TO A DESTINATION. The Prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the Affidavit/Release (defined below) and/or the Winner’s travel documents. No cash equivalent for the Prize will be available. The Prize is not transferable and cannot be substituted by the Winner. However, the Sponsor may, in its sole discretion, choose to substitute the Prize with one of comparable or greater value due to unavailability or for any other reason. As applicable, the Prize (or Prize related documents) will only be mailed/shipped/delivered electronically to persons residing in the U.S. (including D.C.). Any depictions of the Prize in the promotional materials or otherwise are for illustrative purposes only. All federal, state, or other tax liabilities (including but not limited to income taxes for the Winner) arising from participation in the Sweepstakes, or the award of the Prize will be the sole responsibility of the Winner. The Winner will be issued an IRS Form 1099-MISC from the Sponsor or Sponsor’s designee for the total ARV of the Prize won (as stated herein) in the calendar year won. All Prize details are at Sponsor’s sole discretion. Final eligibility for the award of the Prize is subject to eligibility verification, as set forth in these Official Rules. The Sweepstakes Administrator is not the supplier or guarantor of the Prize.

Drawing: The potential Winner will be randomly selected in a drawing held by the Sponsor located in Norwalk, CT on or around June 20, 2024 (“Drawing Date”) from among all eligible Entries received during the Sweepstakes Period.

Notification of Winner: The potential Winner will be notified via email by the Sweepstakes Administrator at the email address associated with his/her Entry within approximately two (2) business days of the Drawing Date. The potential Winner will have two (2) days to respond to the email notification by emailing his/her requested responses to the eligibility questions. If the potential Winner does not respond to the notification within two (2) days; is found to be ineligible; if he/she does not comply with these Official Rules; if his/her Prize or Prize notification message is returned as undeliverable, said potential Winner will be disqualified, and an alternate potential Winner may be selected in the Sponsor’s sole discretion. The potential Winner will be required to sign, have notarized, and return an original unmodified Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively “Affidavit/Release”), and any other documentation that the Sponsor and/or the Sweepstakes Administrator requires within five (5) days after receipt by the potential Winner or such potential Winner may be disqualified, and an alternate potential Winner may be selected. By returning the completed Affidavit/Release, the Winner attests to the provisions stated therein including the accuracy of the information contained therein and compliance with these Official Rules. Each of the Winner’s Guests will be required to sign, have notarized, and return a Liability Release and (where legal) a Publicity Release (“Guest Release”), and any other documentation that the Sponsor and/or Sweepstakes Administrator requires within five (5) days after receipt by the potential Winner.

Personal Information/Publicity Grant: Any personal information supplied by the entrant to the Sponsor will be subject to the Sponsor’s and United Airlines privacy policies listed below. Thus, except where prohibited by law: (1) entry into the Sweepstakes and/or the Winner’s acceptance of the Prize constitutes permission for the Sweepstakes Entities (including Sponsor and United Airlines) to use such entrant’s or Winner’s name, address (city and state), photo, likeness, email address, biographical information, statement, and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on the Website), in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the Prize awarded, and (2) the Sponsor has the right to modify, edit, adapt, electronically alter, use, assign, and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to an entrant or any third parties. Subject to the permissions granted in this paragraph, any personal information supplied by the entrants to the Sponsor and United Airlines will be subject to the Sponsor’s privacy policy, located at https://packages.united.com/pages/privacy-policy.html and United Airlines privacy policy, located at https://www.united.com/ual/en/us/fly/privacy.html. If, at any time, an entrant no longer wishes to receive email communications from Sponsor or United Airlines, such entrant must go to their respective Privacy Policy (as listed above) or the applicable partner’s privacy policy and follow the procedures indicated to unsubscribe. Opting-in to receive communications does not improve one’s chances of winning the Prize.

Entrants understand, agree, and consent that any personally identifiable information provided to the Sweepstakes Administrator may be retained and used for the purposes of this Sweepstakes (including but not limited to any applicable record keeping, tax forms, state registrations, and/or any Prize fulfillment related obligations). The Sweepstakes Administrator does not and will not sell the personally identifiable information of any entrant or winner. Furthermore, the Sweepstakes Administrator will not share or disclose any personally identifiable information to any third-party company or business unrelated to the Sweepstakes, and will comply with all applicable privacy and/or data protection laws.

General Conditions: This Sweepstakes is governed by these Official Rules and all applicable federal, state, and local laws and regulations. By entering the Sweepstakes, entrants agree and acknowledge to be bound by these Official Rules, as well as the decisions of the Sponsor and the Sweepstakes Administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Official Rules; to indemnify and hold harmless the Sponsor and Sweepstakes Entities from any and all liability resulting or arising from the Sponsor or Sweepstakes or the use of any submitted Entry; and to release all rights to bring any claim, action or proceeding against the Sponsor or Sweepstakes Entities. Once submitted, Entries become the sole property of the Sponsor and will not be returned. The Sponsor reserves the right, in its sole discretion, to disqualify any individual (and void all associated Entries) found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of the Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person. Any person attempting to defraud or tamper with the Sweepstakes will be prosecuted and is not eligible for the Prize. If, for any reason, the Sweepstakes is not capable of running as originally planned, the Sponsor, in its sole discretion, reserves the right to cancel, suspend, or modify the Sweepstakes or any portion(s) thereof and to conduct the drawing and award the Prize from all salvageable eligible Entries received prior to and/or after (as appropriate) the action taken by the Sponsor, or award the Prize in a manner that is fair and equitable, as determined by Sponsor. Notice of such action by the Sponsor will be posted on the Website as well as any applicable social media platforms. In case of a dispute over the identity of an entrant who submitted the winning Entry, the authorized account holder of the email address affiliated with that Entry will be deemed the entrant. Said person must comply with these Official Rules, be the person who completed the act of entering, and, in the Sponsor’s sole discretion, may be required to provide proof of ownership of the email account.

Disclaimers: The Sponsor and Sweepstakes Entities are not responsible or liable for Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), in excess of the stated limit, or for Entries that are illegible, late, tampered with, forged, incomplete, misdirected, deleted, damaged, lost, misplaced, stolen, destroyed, dropped, inaccessible, corrupted, jumbled, or otherwise not in compliance with these Official Rules. Any such Entries will be disqualified. By entering the Sweepstakes, the entrants agree and acknowledge that the Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury, or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of the Entry Information; acceptance/possession, use/misuse, and/or defects of the Prize (including any travel related thereto or a Prize element) awarded herein; typographical errors in the Sweepstakes promotional material; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider utilized by the Sweepstakes; any interruption or inability to access the Sweepstakes, the Website (or Sponsor’s/Sweepstakes Administrator’s inability to access content on the Website) or any online service via the internet due to hardware or software compatibility problems; wireless network dead zones or obstructions; any damage to an entrant’s (or any third person’s) computer/mobile device and/or its contents related to or resulting from any part of this Sweepstakes or from entering or downloading materials/software in connection with the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions; any fraudulent (including unauthorized) voucher/ticket/certificate/coupon uses made with lost, stolen, misplaced, or misappropriated vouchers/tickets/certificates/coupons, incomplete (including inaccurate) voucher/ticket/certificate/coupon database information and canceled voucher/ticket/certificate/coupon amounts or expired vouchers/tickets/certificates/coupons; and/or cancellations, delays and/or policies that may affect the Winner’s and/or his/her Guest(s)’ travel, or any change by the air carrier(s), lodging facilities, or other company or any other persons providing any components of the Prize for the Winner and his/her Guest(s) due to reasons beyond the Sponsor’s and/or the Sweepstakes Entities’ control even if caused by the negligence of one of the Sweepstakes Entities. Entrants hereby acknowledge that the said Sweepstakes Entities and Sponsor have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Kempinski Hotel Cancun and United Airlines portion of the Prize, including express warranties provided exclusively by Kempinski Hotel Cancun and United Airlines that are sent along with the Prize. The Sweepstakes Entities and Sponsor shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity that may be caused by or have contributed to (1) any wrongful, negligent or unauthorized act or omission on the part of the other Prize Providers or any of its agents, servants, employees, or independent contractors, (2) any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsor, or (3) any other cause, condition, or event whatsoever beyond the control of the Sponsor or its parents, subsidiaries, and affiliated companies. The failure of Sponsor and/or the Prize Providers to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, demonstrations, riot, earthquake, terrorism, act of public enemies, strikes, epidemics, pandemics, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

GOVERNING LAW, JURISDICTION, ARBITRATION: Any controversy or claim arising out of or relating to (i) the Sweepstakes, (ii) the awarding of the Prize or redemption of the airline portion of the Prize, and/or (iii) the determination of the scope or applicability of these Official Rules or their enforcement or interpretation shall be governed by and construed in accordance with the substantive laws of the U.S. state of Connecticut without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. Any controversy or claim arising out of or relating to this agreement, its enforcement, arbitrability, or interpretation shall be submitted to final and binding arbitration, to be held in Fairfield County, Connecticut before a single arbitrator. The arbitrator shall be selected by mutual agreement of the Sponsor and the entrant or entrants bringing forth the controversy or claim, which to the extent permissible must be brought individually and not as part of a class/group (collectively, the “Parties”) or, if the Parties cannot agree, then by striking from a list of arbitrators supplied by the American Arbitration Association or JAMS/Endispute. The arbitration shall be a confidential proceeding, closed to the general public. The arbitrator shall issue a written opinion stating the essential findings and conclusions upon which the arbitrator’s award is based. The Parties will share equally in payment of the arbitrator’s fees and arbitration expenses and any other costs unique to the arbitration hearing (recognizing that each side bears its own deposition, witness, expert and attorneys’ fees and other expenses to the same extent as if the matter were being heard in court). Each entrant agrees that his/her claim will be resolved individually, exclusively by arbitration, without resort to any form of class action. Each entrant further agrees that any claim/judgment/award in such arbitration shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Sweepstakes but in no event attorneys' fees; and, under no circumstances, will any entrant be entitled to awards.

Any disputes, claims, and causes of action against the Sponsor arising out of or relating to any person’s use of or participation in Sweepstakes shall be resolved by applying the laws of the State of Connecticut, without regard to its conflict of laws, rules or provisions that would cause the application of any other jurisdiction’s laws. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.

Each entrant hereby waives all rights to claim punitive, incidental, special and consequential damages and losses, and any other damages and losses, other than for actual out-of-pocket expenses or any similar kind arising out of or in connection with terms of these Official Rules. Should any term of this section be deemed by a tribunal of competent jurisdiction void, unenforceable or contrary to law, such term shall, but only to the extent necessary to bring this section within the requirements of law, be deemed to be severed from the other terms of these Official Rules, and the remainder of these Official Rules shall be given effect as if it had not included the severed term herein. THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

All requests must be received by August 14, 2024. The Official Rules will be available on the Website during the entire Sweepstakes Period. The name of the Winner may also be posted on the Website.
